Benefit Plan Investor

Benefit Plan Investors are typically entities that manage money from a retirement plan or employee benefit package.

A “Benefit Plan Investor” is defined as:
(i) an entity that is deemed to be a “benefit plan investor” under the U.S. Department of Labor final plan assets regulation, 29 C.F.R. §2510.3-101, as amended (the “Regulation”) and as modified by Section 3(42) of ERISA.

“Benefit Plan Investors” manage:
(i) an “employee benefit plan” (as defined in Section 3(3) of ERISA), that is subject to part 4 of Title I of ERISA, OR
(ii) a “plan” (as defined in Section 4975(e)(1) of the Code), that is subject to Section 4975 of the Code.
